Terms and Condition

By placing an order for a photoshoot, the client confirms that they have read, understood, and accepted these terms and conditions, including the pricing conditions, as well as the photographer's artistic approach and photographic style, with which they have no objections.

COPYRIGHT

All photographs are subject to the photographer's copyright. Photos may not be used for any commercial purposes without written consent (except for commissioned commercial shoots). Photographed persons may use the photos for their own non-commercial personal presentation. Photos may not be altered, filtered, or edited by third parties in any way.

BOOKING A PHOTOSHOOT

Please book photoshoots via the contact form or by phone well in advance. Specify the type of photoshoot, who will be photographed, and propose several possible dates.
For outdoor shoots, in case of bad weather, the shoot can be postponed to the nearest suitable date. By placing an order, the client automatically accepts these terms and conditions and agrees to them.
The agreed date is binding for both parties.

TRAVEL COSTS

For photoshoots outside Plzeň, a travel fee of 5.50 CZK per kilometer will be charged.

CANCELLATION POLICY, MENTORING, COMPLAINTS

If the client cannot attend the photoshoot for any reason, they must notify the photographer by phone at least 48 hours in advance, otherwise the deposit will be forfeited. In case of timely cancellation, the date can be changed twice, but no later than two months from the original date.
The agreed time must be strictly observed; early arrival is not desirable, and late arrival of more than 30 minutes may result in cancellation without compensation.
If the shoot is cancelled while the photographer is already en route, the client will also cover travel expenses.

Inappropriate or offensive behavior by the client's accompanying persons may result in termination of work and delivery of unfinished material without price reduction.
Dissatisfaction with one's own appearance is not a valid reason for complaint regarding the photographs.

WORKSHOPS AND MENTORING

If a client cannot attend a workshop (WS) and does not find a replacement, the fee is forfeited. If cancellation is made at least one week before the workshop and with sufficient participants, the fee may be transferred once to another workshop or mentoring session.
If the organizer cancels the workshop, the full amount is refunded or can be credited toward another workshop, course, or mentoring of equal value.

Mentoring and workshops must be paid in advance upon booking.

ONLINE COURSE

If you agree to receive digital content, the right to withdraw from the contract expires 14 days after delivery of the content.

RESERVATION AND DEPOSIT

A deposit is required to reserve a date and must be paid before the shoot; it is non-refundable. The reservation is valid only after the deposit has been received. Cancellation conditions apply as stated above.
The deposit for regular photoshoots is 50% of the chosen package price, but at least 1,000 CZK.

DURATION OF THE PHOTOSHOOT

Each package has an estimated shooting time. Late arrival by the client does not extend the shooting time. If the client is more than 30 minutes late, the photographer reserves the right to cancel the shoot.

PAYMENT AND PRICE

Prices are according to the valid price list on the day of the order. Payment is due in full before the shoot, either in cash or by bank transfer. Please prepare exact cash if paying on-site.
Extra photos beyond the package are payable by bank transfer.
Final photos will be delivered only after full payment.

PHOTO SELECTION

You select photos from previews sent within 14 days after the shoot via an online gallery. Selections must be returned within 7 days. After this period, the gallery will be closed. Please notify the photographer when you finish selecting. If delayed, the photographer may extend the delivery time.
By copyright law no. 121/2000 Coll., previews may not be published or edited without the photographer's permission. They are the photographer's property and intended solely for selection purposes.
If photos are not selected within 3 weeks, the photographer will edit and send a selection at their discretion without possibility of change.

FINAL PHOTOS

All edited photos are delivered in full resolution electronically via a password-protected JPG gallery.
Unedited photos are not provided. Final color grading reflects the photographer's style and vision (contrast, color, curves, cropping). Requests for additional retouching (e.g., skin or body adjustments, proportion changes) are charged separately. Color changes or style modifications are also priced individually.
Edited photos are backed up for 6 months.

DELIVERY TIME FOR FINAL PHOTOS

Delivery time is up to 5 weeks from the date of your photo selection, not from the shoot date.
Processing time may be extended in case of illness or vacation, in which case the client will be informed.

COMPLAINTS

Dissatisfaction with editing or the photographer's style is not a reason for complaint.

REOPENING THE GALLERY

If a client wants to make additional selections after 30 days from delivery, a fee of 300 CZK is charged per reopening. Pricing for individual photos is handled case by case.

BRAND/COMMERCIAL/PRODUCT PHOTOGRAPHY

Subject to general terms and conditions unless otherwise specified. By ordering, the client confirms acceptance of these terms and understands the photographer's artistic style and approach.
Licenses are granted for marketing use, websites, social media, and newsletters. Usage for large print runs, merchandising, books, or advertising campaigns beyond web and social media is priced individually.
The photographer reserves the right to use photos in their portfolio and for promotion.
Payment must be received in full before the shoot.

CONSENT TO PHOTO USE

The photographer reserves the right to use photos in their portfolio. If the client does not wish for their photos to be published, they must notify the photographer immediately after the shoot at the latest. Silence will be considered consent. Consent can be revoked in writing or by email at any time.

EXPRESS PHOTO DELIVERY

Additional service: delivery within 7 days from sending selections, digital only. Price: 1,000 CZK. Payment in full is made in cash after the shoot.

ADDITIONAL RETOUCHING

Requests for advanced retouching beyond usual minor corrections (e.g., pimples, small blemishes) will be priced separately. This applies also to newborns if significant skin issues are present.

PRINTED PHOTOS PICKUP

Printed photos can be collected at: Čelakovského 9, 310 00 Plzeň
Shipping by mail incurs a 100 CZK fee for packaging and postage.

PRINTING PHOTOS ELSEWHERE

If you print photos elsewhere, color and quality may be affected. We recommend choosing options that avoid automatic color adjustments or enhancements.
